General Terms and Conditions

Effective from January 21, 2026

I. Basic Provisions

  1. These terms and conditions govern, in accordance with Section 1751(1) of the Civil Code, the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase contract and a contract for the provision of digital content concluded between the seller and the buyer through the seller's internet platform available at storysong.cz.
  2. By buyer, we mean you, whether you are a consumer or an entrepreneur, within the meaning of the applicable legal regulations.
  3. By seller, we mean the operator of the StorySong.cz platform: Vít Nehasil, with registered office at Vejvanovského 1619/14, Prague 4 14900, Czech Republic, identification number: 06329403, registered in the trade register maintained by the Municipal Office of Prague 11. Contact details: info@storysong.cz.
  4. By Civil Code, we mean Act No. 89/2012 Coll., the Civil Code, as amended. By Copyright Act, we mean Act No. 121/2000 Coll., on Copyright and Rights Related to Copyright and on Amendment to Certain Acts (Copyright Act), as amended.
  5. By ordering goods/digital content, we mean the process of concluding a purchase contract, the parties to which are you and us, the subject of which is our obligation to deliver the goods that are the subject of the purchase and to enable you to exercise the relevant rights, and on the other hand, your obligation to accept the goods and pay us the purchase price.
  6. By goods and digital content, we mean the creation of unique musical compositions according to the individual specification of the buyer. The resulting musical composition is an intangible thing and digital content within the meaning of the Civil Code. Due to the use of AI technologies in creation, it may or may not meet the conceptual features of a copyright work within the meaning of Section 2(1) of the Copyright Act. The buyer has the option to order physical goods as optional accessories to the digital content in the form of an engraved plaque with a QR code for access to the song.
  7. With regard to the type of goods we offer for order, we have all the necessary legal prerequisites for their creation and enabling the exercise of the relevant rights in the territory of the Czech Republic.
  8. All texts, graphics, illustrations, photographs, as well as other accompanying materials accessible on the platform are copyrighted works within the meaning of applicable legal regulations, to which we exercise copyright in full.
  9. These terms and conditions form an integral part of the content of the contract. The contract and terms and conditions are drawn up in Czech. The contract may also be concluded in other languages; however, Czech is decisive.
  10. By concluding the contract, you accept these terms and conditions in their current version as of the date of the contract.
  11. We may change or supplement the wording of the terms and conditions. This provision does not affect the rights and obligations arising during the validity of the previous version of the terms and conditions.
  12. Information on the processing of personal data is provided in the Privacy Policy available at storysong.cz/privacy.

II. Information on Prices, Payments and Shipping

  1. All prices quoted are contractual, final and are presented in CZK including all taxes and fees. If the price is stated incorrectly, we will proceed according to the steps in Part III of these terms.
  2. The purchase price cannot be changed unilaterally. Any discounts from the price of goods provided by the seller cannot be combined with each other, unless otherwise stated on the platform.
  3. We do not require a deposit or other similar payment from you. This does not affect the obligation to pay the price of goods in advance before delivery.
  4. Payment for goods is made cashless through the PayU payment gateway. We support payments by credit cards (Visa, Mastercard, Maestro), bank transfer, Apple Pay, Google Pay and other payment methods available in the payment gateway.
  5. The PayU payment gateway ensures secure payment processing in accordance with international PCI DSS standards. Payment card details are not stored on our servers.
  6. The obligation to pay is normally fulfilled when the corresponding amount is credited to our account.
  7. Digital content (musical composition) is delivered online through the song portal on the StorySong.cz platform. The song portal is also accessible from the customer's user account. Digital content is made available for download immediately after creation and quality control.
  8. If an engraved plaque is ordered, it is delivered physically to the address specified in the order. The customer can choose one of the following delivery methods: home delivery via DPD courier service, pickup at a DPD Pickup Box, or pickup at an AlzaBox.
  9. The shipping cost for the engraved plaque is shown in the order form and is added to the order price. Current shipping prices are displayed when selecting the delivery method.
  10. The delivery time for the engraved plaque is usually 1-5 business days from shipment. The customer is notified by email when the shipment is dispatched.
  11. The exercise of the relevant rights is enabled to the buyer upon receipt of the goods or full payment of the price, whichever occurs later.

III. Conclusion of Purchase Contract

  1. The purchase contract is concluded when the acceptance of the proposal for its conclusion (offer) is delivered to the other party. Acceptance of this offer with any addition or deviation is not acceptance of the offer in the legal sense and has no legal effect.
  2. Presentation of goods and information about them: Proposals to deliver goods for a specified price on our platform do not constitute an offer, i.e., by simply accepting such a "proposal" to deliver goods and sending your order, you cannot yet express your will to conclude a purchase contract for these goods. All presentation of goods placed on the platform is for informational purposes only.
  3. An offer in the legal sense is therefore only your order sent through the internet order form. The condition for such a valid order is the truthful and complete filling in of all required data and requirements specified in the order form, as well as familiarization with and consent to these terms.
  4. You will make the order by filling in all required fields in the order form, familiarizing yourself with the text of these terms and conditions and expressing your consent to them, and then confirming the order to send your offer.
  5. Until you send the order, you can check and change the input data you enter in the order.
  6. Once you place the order (make the offer), we will process it without delay and confirm its acceptance electronically to the e-mail address you provided.
  7. You can withdraw your offer until the acceptance of the offer is sent, without giving a reason, to our email address info@storysong.cz.
  8. In case of incorrectly stated price: If the ordered goods have an incorrect price on our platform, we will immediately state the correct price in response to your order. Such a response is not an acceptance of the offer, but a counter-offer, and the conclusion of the purchase contract requires you to confirm this new price.
  9. The seller reserves the right to refuse the order if it is incomplete, incomprehensible, or if its fulfillment would be contrary to the legal order, good morals or technical possibilities.
  10. By submitting the order and agreeing to these terms, the buyer expressly requests the commencement of performance before the expiry of the withdrawal period and acknowledges that this forfeits the right to withdraw.

IV. Creation Process

  1. The creation of musical compositions is provided by the operator of the StorySong.cz platform.
  2. The customer submits their requirements through the order form (story, names, occasion, preferred genre, etc.).
  3. The operator creates a text draft of the composition based on the specification, with possible use of AI tools.
  4. Based on the text, a musical composition is generated using licensed AI tools.
  5. The final composition undergoes a quality control check before being sent to the customer.
  6. The operator reserves the right to delegate individual steps of the process to external collaborators, while the operator always bears responsibility for the final quality.

V. Delivery of Goods

  1. Delivery of digital content (musical composition) is carried out online through the song portal on the StorySong.cz platform. The song portal is also accessible from the customer's user account, where they can play and download the composition. The digital content is made available for download to the buyer for the duration of the StorySong.cz platform's existence. Once downloaded, the media file is available to the buyer without time limitation. The seller recommends that the buyer download the digital content immediately after it is made available.
  2. Digital content is delivered in MP3 format by default. The buyer has the option to order delivery in WAV format for an additional fee.
  3. If an engraved plaque is ordered, it is delivered physically to the address specified in the order via a courier service. The buyer is obliged to provide a correct and complete delivery address. In case of an incorrectly specified address, the buyer bears responsibility for delivery problems.
  4. The engraved plaque is a physical product made to order with personalized text and a QR code for access to the song. Due to the personalized nature of the product, the plaque cannot be returned or exchanged if it was manufactured in accordance with the order.
  5. When ordering digital content, you are obliged to provide a specific e-mail address for delivery. In case of an incorrectly specified e-mail address, you bear responsibility for delivery problems.
  6. If it is necessary to deliver the goods repeatedly or in a different way than specified in the order for reasons on your part, you bear the costs associated with the repeated delivery of the goods.
  7. Upon receipt of physical goods (engraved plaque), you are obliged to check their integrity and in case of any damage during transport, report this to us immediately at our e-mail address info@storysong.cz.
  8. The delivery period begins from the full payment of the purchase price. The standard length of the delivery period for digital content is indicated for individual service packages. The delivery period for the engraved plaque is usually 5-10 business days from payment.
  9. The buyer has the option to order express delivery of digital content for an additional fee (usually within 24 hours of payment). Availability and conditions of express delivery are specified in the order form.
  10. The buyer has the option to order a revision service for an additional fee, which allows requesting modifications to the finished composition. The scope and conditions of revisions are specified in the order form.
  11. If the ordered goods cannot be delivered within the specified period, we will inform you immediately and set a substitute delivery deadline by mutual agreement.
  12. The invoice issued on the basis of the purchase contract also serves as a tax document and delivery note.

VI. Our Liability

  1. To the maximum extent possible, we are responsible for ensuring that the goods have no defects upon receipt (such defects are understood to mean, in particular, that the goods do not have the agreed properties, are not suitable for the purpose you requested or for which goods of that kind are normally used).
  2. However, you are not entitled to the right from defective performance if you knew before taking over the goods that the goods had a defect, or if you caused this defect yourself.
  3. In creating musical compositions, we use artificial intelligence (AI) technologies as an auxiliary tool to help us realize your specification. The final composition is always reviewed and edited by a human to meet your requirements.
  4. The seller does not guarantee a specific aesthetic result, style or emotional tone of the composition. Due to the creative nature of the service, the result may be subject to subjective perception.
  5. The seller is not liable for delays in performance or inability to perform caused by force majeure circumstances, including outages or unavailability of third-party services used in creation (especially AI tools and platforms), technical failures, cyber attacks, or decisions by public authorities. In such circumstances, the seller will promptly inform the buyer and propose an alternative performance date or refund of the purchase price. If the obstacle lasts longer than 14 days, the buyer has the right to withdraw from the contract with a claim for refund of the purchase price.
  6. Due to the creative nature of the service, it is not possible to claim the composition due to subjective dissatisfaction with the style, sound or other aesthetic elements. Similarly, the claim cannot be accepted in the case of incorrectly entered data by the buyer.
  7. The claim can be accepted in case of technical defects – e.g., in case of a damaged file, inability to play it, incorrect download link, or in case of force majeure.
  8. In case of the engraved plaque, manufacturing defects (incorrect engraving, damaged material) or damage during transport can be claimed. The claim must be made immediately upon receipt of the shipment.
  9. Complaints will be resolved within 30 days from the date of their submission, unless a longer period is agreed with the buyer.
  10. All possible exercises of defect rights must be made to our e-mail address info@storysong.cz.

VII. Withdrawal from Purchase Contract

  1. Due to the nature of the goods, it is not possible to withdraw from the purchase contract, as according to Section 1837 of the Civil Code, it is not possible to withdraw from a purchase contract for the delivery of goods made according to your requirements or adapted to your personal needs. This applies to both digital content (musical composition) and physical goods (engraved plaque).
  2. Similarly, due to the nature of the goods, it is not possible to withdraw from the contract for the delivery of digital content, as this is not delivered on a tangible medium and performance has already begun and you have given explicit consent to performance before the expiry of the withdrawal period, thereby forfeiting this right.
  3. The engraved plaque is goods made to order with personalized text, and therefore the exception from the right of withdrawal under Section 1837 of the Civil Code also applies to it.
  4. It is possible to withdraw from the contract only exceptionally, namely when the goods have not been delivered or are technically inaccessible and as such are practically unusable (and at the same time such defect is not insignificant). Such withdrawal must be made without undue delay after delivery of the goods and discovery of the said unusability, via the e-mail address info@storysong.cz.
  5. If you withdraw from the contract, we may prevent you from further using the digital content, in particular by making the digital content inaccessible.
  6. In case of withdrawal according to the previous paragraph, we are obliged to refund the purchase price, if it has already been paid.

VIII. Special Provisions on Digital Content

  1. If you are a consumer, the following points apply to the provision of digital content.
  2. If we are in delay with making the digital content available, you may withdraw from the contract if we do not fulfill our obligation without undue delay after you call us to perform or within an additional period on which we expressly agree with you.
  3. We are responsible to you for ensuring that the digital content corresponds to the agreed description and scope, as well as quality, functionality, compatibility, interoperability and other agreed properties.
  4. The digital content is suitable for the purpose for which you require it and to which we have agreed.
  5. The digital content is provided with the agreed accessories and instructions for use.
  6. You may point out a defect that manifests itself or occurs in the digital content during the duration of the obligation. In the case of a one-time performance, you may point out a defect that manifests itself in the digital content within two years of making it available.
  7. We will remove any defect within a reasonable time after it has been pointed out, so as not to cause you significant inconvenience, taking into account the nature of the digital content and the purpose for which you required it.
  8. Due to the nature of the digital content (one-time delivered musical composition), no updates are provided.

IX. Intellectual Property Rights

  1. The buyer acknowledges that the resulting content is created using artificial intelligence technologies. Due to the nature of these technologies, the seller does not guarantee that copyright within the meaning of the Copyright Act will arise in the resulting content. The seller declares that it has the authorization to use and further dispose of the outputs of the AI tools used to the extent enabling the provision of rights under these terms.
  2. The buyer acknowledges that due to the nature of artificial intelligence technologies, the same or similar output may be generated for other users of these technologies. The seller does not guarantee absolute uniqueness of the resulting composition from a technical standpoint.
  3. For the handling of rights to digital content, the buyer and the seller have agreed on the following regime.
  4. The seller hereby transfers to the buyer all rights to the digital content that the seller has acquired from the providers of the AI tools used, and simultaneously grants the buyer a non-exclusive, territorially unlimited and time-unlimited license to use the digital content for personal and non-commercial purposes.
  5. The buyer has the right to share, reproduce, record, stream, include the digital content in videos, podcasts, or use it in any other way for personal and non-commercial purposes.
  6. The license is granted without limitation on the number of uses, with the possibility of further technical processing (e.g., mastering, editing, remix).
  7. The license is granted without the right to transfer or sublicense to third parties without the written consent of the seller, unless otherwise agreed between the parties.
  8. The license is granted for payment, within the scope of the purchase price paid for the goods.
  9. The license becomes effective upon delivery of the goods to the buyer.
  10. The buyer is not entitled to claim authorship of the content of the goods unless individually agreed. However, the buyer is entitled to refer to themselves as the "orderer" or "initiator" of the project.
  11. The seller retains the right to keep copies of the created outputs for archival and technical purposes, or to analyze them anonymously for the purpose of improving the quality of the service or developing the platform. Without the explicit consent of the buyer, however, the content or any part of the outputs will not be publicly published or re-licensed to other entities.
  12. The buyer is responsible for any infringement of the rights of third parties if they provide materials within the specification (e.g., texts, musical motifs) that are protected by copyright or other rights.
  13. In case of violation of the license terms, the buyer's license may be immediately revoked and the seller is entitled to claim damages.
  14. A license for commercial purposes (including use in advertising, commercial videos, monetized content, etc.) is not included in the standard order. A buyer interested in commercial use of the digital content is required to request a license extension in writing through the seller's contact details. A commercial license may be charged separately.
  15. The buyer has the option to order a distribution service for digital content on streaming platforms (e.g., Spotify, YouTube Music and others). In such case, the buyer agrees to the publication of the composition on these platforms and acknowledges that the composition will be publicly accessible to third parties.
  16. Data provided by the buyer as part of the order (story, names, preferences) are stored as part of the order for the purposes of contract performance, potential complaints and archiving in accordance with legal requirements. More information on the processing of personal data is provided in the Privacy Policy.

X. Out-of-Court Dispute Resolution

  1. We handle consumer complaints via e-mail. Complaints can be sent to info@storysong.cz. We will send you information on the handling of the complaint to your e-mail address.
  2. The Czech Trade Inspection Authority, ID 00020869, with its registered office at Štěpánská 567/15, 120 00 Prague, with a platform available at: https://coi.gov.cz/informace-o-adr/, is competent for out-of-court resolution of consumer disputes from the purchase contract.
  3. Alternatively, it is possible to use the online dispute resolution platform under the European Commission available at: https://ec.europa.eu/consumers/odr.
  4. The European Consumer Centre Czech Republic, with its registered office at Štěpánská 567/15, 120 00 Prague, available at: http://www.evropskyspotrebitel.cz, is the contact point under Regulation (EU) No. 524/2013 of the European Parliament and of the Council.

XI. Final Provisions

  1. If the relationship established by the purchase contract contains an international (foreign) element, the parties agree that the relationship is governed by Czech law.
  2. The choice of law according to the previous sentence does not deprive the buyer, who is a consumer, of the protection provided by the provisions of the legal order from which it is not possible to contractually deviate.
  3. The purchase contract is concluded in Czech. If a translation of the text is created for your needs, in case of a dispute about the interpretation of terms, the interpretation according to Czech applies.
  4. The purchase contract and the contract for the delivery of digital content, including the terms and conditions, are archived by the seller in electronic form.
  5. By this, you agree to the use of means of distance communication when concluding the purchase contract. The costs incurred by you when using means of distance communication in connection with the conclusion of the purchase contract (internet connection costs) are borne by you.
  6. These terms and conditions take effect on January 21, 2026.
